Digital Millennium Copyright Act (DMCA) Notice

This DMCA policy outlines the procedures we follow to respond to copyright infringement notifications in accordance with the Digital Millennium Copyright Act. At rkytxyz we respect the intellectual property rights of others and expect our users to do the same.

Filing a DMCA Takedown Notice

To file a DMCA complaint please provide the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material that is claimed to be infringing with sufficient detail to allow us to locate the material.
  3. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner its agent or the law.
  4. A statement that the information in the notification is accurate and under penalty of perjury that you are authorized to act on behalf of the copyright owner.
  5. Your full name and contact information including your email address.

Response to Takedown Notices

Once we receive a valid DMCA notification we will remove or disable access to the infringing content as quickly as possible. We will also notify the user who posted the allegedly infringing material so they may have the opportunity to submit a counter-notification if applicable.

Counter-Notification Process

If you believe that the content removed was misidentified or removed in error you may submit a counter-notification. To be effective the counter-notification must include:

  1. Identification of the material that has been removed and the location at which the material appeared before it was removed.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name address and telephone number and a statement that you consent to the jurisdiction of the federal district court in your area.
  4. Your physical or electronic signature.

Upon receiving a counter-notification we may reinstate the removed material within ten to fourteen business days unless we receive notice from the original complainant that they have filed a court action against you.

Repeat Infringers

We reserve the right to terminate user accounts that are subject to repeated DMCA complaints.
